As soon as the size of a biogas plant exceeds the applicable limit values in accordance with the 4th Federal Immissions Ordinance (4. BImSchV referring to plants that require approval), approval proceedings in accordance with the Federal Immissions Act (BImSchG) will not be avoidable:

Approval in accordance with BImSchG includes the building permission as well as veterinary approval of the biogas plant in accordance with VO (EG) 1069/2009 (concentration effect of the immissions law permission).
In comparison, the application documents for approval proceedings in accordance with BImSchG are distinctly more comprehensive, since all details of compliance with the duty of diligence vis-à-vis the environment will have to be taken into account.
